JUDGMENT
[1]This has been a remote hearing which has been consented to by the parties. The form of remote hearing was A (fully remote). A face to face hearing was not held because it was not practicable and all issues could be determined in a remote hearing.[2]The claimant’s claim for holiday pay succeeds.[3]The respondent is ordered to pay the claimant the sum of £194.29 gross in respect of holiday pay. This represents 3 days’ holiday at a day rate of £104.63 (totalling £313.89), less £119.60 already paid to the claimant by way of furlough “top up” payment.[4]The respondent is entitled to deduct such tax and national insurance contributions as may be appropriate before payment is made to the claimant.
