JUDGMENT

[1]The claimant’s claim of unfair dismissal is dismissed. The tribunal does not have jurisdiction to hear the claimant’s claim for unfair dismissal because a) The Claimant presented her complaint of unfair dismissal out of time. b) It was reasonably practicable for the Claimant to present her claim in time and the claimant did not present her claim within a reasonable period after the expiry of the primary time limit. Time is not extended for its presentation.[2]The Claimant presented her complaints of discrimination on the grounds of disability, race and religious belief out of time. It is just and equitable to extend time for the presentation of the Claimant’s claim and the Claimant’s claims of discrimination are permitted to proceed to a hearing.
