JUDGMENT

[1]The Respondent proposed to dismiss as redundant 20 or more employees at one establishment within a period of 90 days or less. Those employees included the Claimants.[2]Further to that proposal, the Claimants were dismissed by reason of redundancy on 3 May 2024.[3]The Respondent failed in relation to that proposal to organise the election of employee representatives and to consult with them in accordance with sections 188 and 188A of Trade Union and Labour Relations (Consolidation) Act 1992 (“TULRCA”). The Claimants’ complaints pursuant to TULRCA section 189 are well founded.[4]The protected period in relation to the Claimants is 90 days, beginning on 3 May 2024. 1 of 2 Case Numbers: 1306302/2024, 1306303/2024, 1306304/2024, 1306305/2024[5]The Respondent must pay each of the Claimants a protective award, consisting of remuneration for the protected period.[6]Reasons were given orally at the hearing.
