JUDGMENT

In exercise of my powers contained in Rule 37 of the Employment Tribunals (Constitution and Rules of Procedure) Regulations 2013 the complaint of unfair dismissal is struck out.

REASONS

The claimant was asked by a letter sent on 31 January to provide reasons why his complaint of unfair dismissal should not be struck out as he has less than the two years service required by section 108 of the Employment Rights Act. He did not reply to that letter and has not attended the case management hearing today Employment Judge Monk 28 March 2019 Case No:1305870/2018 6.2 Strike out Judgment – claim - rule 37 EMPLOYMENT TRIBUNALS Claimant: Mr A Fekete Respondent: Evolution Food Ltd JUDGMENT The claim for disability discrimination is struck out. REASONS[1]By a case management order dated 28 March 2019 the Tribunal required the claimant to provide full details of his disability, copies of his medical records and an impact statement and gave notice that unless he did so by 24 April 2019 his claim may be struck out. the claimant has not complied with the Order of the Tribunal dated 28 March 2019 and has not sought an extension.[2]The claim is therefore struck out for non compliance.[3]The hearing fixed for 31 May 2019 will not take place.
