The claim is dismissed.REASONS
[1]By notice dated 15 April 2024 the Tribunal notified the claimant about the final hearing date as 11 September 2024 at 10 a.m. The claimant was informed on 10 September 2024 by the Tribunal that the hearing would start at 10.30 a.m. The claimant failed to attend the hearing and was contacted by the Tribunal clerk on two occasions via the claimant’s mobile telephone. The call went to voicemail. The claimant was emailed by the Tribunal to attend the hearing but he failed to respond.[2]The claimant last contacted the Tribunal by email on 23 February 2024. Pursuant to a case management order dated 15 April 2024, the claimant was to provide a schedule of loss to the respondent by 13 May 2024; he failed to do so. The respondent served the claimant via email a bundle of documents and respondent’s witness statements on 5 September 2024 and served the papers via registered post. The papers were signed for on 7 September 2024.[3]The Tribunal determined on the respondent’s application to dismiss the claim on the basis that the claimant failed to attend the final hearing of his claim.[4]Furthermore the Tribunal noted that the claimant has failed to comply with a case management order dated 15 April 2024 to provide a schedule of loss. and failed to make representations or to request a hearing, as to why his claim should not be struck out. 6.2 Strike out Judgment – claim - rule 37 Case No. 1305823/2023
