JUDGMENT

[1]The respondent failed to attend or be represented at the Remedy Hearing. The Tribunal considered the information in its possession and decided to proceed in his absence.[2]The respondent is ordered to pay the claimant compensation for unfair dismissal of £16800. (see the Schedule attached). The Recoupment Regulations do not apply.[3]The respondent has made an unauthorised deduction from the claimant's wages and is ordered to pay the claimant the gross sum of £444 (30 hours per week x 2 x £10.00 per hour-12 hours per week x 2 x £6.50 per hour). 4The respondent is ordered to pay £0 damages for breach of contract in respect of notice to the claimant to avoid double recovery (see Schedule attached). 5The claimant is not entitled to a redundancy payment.[6]The respondent has failed to pay the claimant’s accrued but untaken holiday entitlement (136 hours) and is ordered to pay the claimant the sum of £1363 (136 x £10 per hour).[7]The respondent is ordered to pay a penalty to the Secretary of State pursuant to s.12A Employment Tribunals Act 1996 of £500.
