JUDGMENT
In accordance with Rule 47 of The Employment Tribunals Rules of Procedure 2013, the claims are dismissed.REASONS
[1]The Notice of Hearing was sent to the address the Tribunal has on file for the claimants on 14 February 2024.[2]There was no correspondence from the claimants explaining that they would not be in-attendance.[3]Several enquiries were made to no avail:a. Two phone calls to the phone number the Tribunal has on file for the claimants. There was no answer. PHCM Order 1 of 3 September 2023b. An email to the email address the Tribunal has on file for the claimants. There was no response within the time the Tribunal waited before making a decision.c. The Tribunal inbox was checked for correspondence from the claimants, nothing was located.d. Mr Soni confirmed he had no engagement with the claimants, since the Case Management Hearing in January 2024, save for one email sent by Mrs Fuller on 17th January. Mr Soni forwarded that correspondence to the Tribunal which I had sight of. Mr Soni replied to Mrs Fuller’s email on 18th January 2024 and offered to have a phone call with her to explain what was required following the hearing, he included his contact number in the email. There was no response to the email and no call was received by Mr Soni.e. Mr Soni confirmed that the claimants had no involvement in preparing the hearing bundle.f. The claimants had not provided any witness statements, submissions or any other documents demonstrating engagement with proceedings.[4]The claimants did not join the hearing belatedly or respond to the contact made.
