Ms R K Ali v Desired Care 4U Ltd: 1305110/2021
JUDGMENT
[1]The claimant’s claims are dismissed.REASONS
[2]By claim form dated 10 December 2021 the claimant brought complaints of race and disability discrimination, public interest disclosure detriment, and claims for other payments.[3]The case was listed for a preliminary hearing in May 2022 but was postponed on the claimant’s request. The case was further listed for hearing in July but was postponed by the Tribunal.[4]By notice dated 12 October 2022 the parties were informed of today’s hearing. The claimant did not attend the hearing today. The respondent’s representative stated he had not heard from the claimant since the summer of 2022. The Tribunal clerk attempted to contact the claimant by telephone to invite her to join the hearing but was unable to speak to her and the call went to voicemail. Prior to the hearing today there was no communication from the claimant to explain her non-attendance today.[5]The Tribunal faces a large back log of cases. Parties non-attendance at listed hearings is a waste of judicial time and resource. Parties are expected to contact the Tribunal if they are unable to attend the hearing.[6]In the absence of any explanation for the claimant’s non-attendance today the Tribunal determines that it is in the interests of justice to dismiss the claim pursuant to Rule 47 of the 2013 Rules.
