[1]It was agreed the respondent made an unlawful deduction from the claimant’s wages pursuant to Part II of the Employment Rights Act 1996. It was agreed the respondent shall pay £2,548.57 (gross) to the claimant in respect of the unlawful deduction.[2]It was agreed the respondent was in breach of its duty to the claimant pursuant to section 1(1) and/or 4(1) of the Employment Rights Act 1996. The respondent is ordered to pay an additional 4 weeks pay (£1,961.54 gross) to the claimant pursuant to Section 38 of the Employment Act 2002.[3]It was agreed the respondent is entitled to offset from any net sum payable to the claimant the net sum of £2,987.78 Employment Judge Perry 4 August 2020 Note.
