Employment Tribunals Rules of Procedure 2013 – Rule 21 In default of the Respondent presenting a Response within the relevant time limit and having regard to Rule 21, Schedule 1 of the Employment Tribunals (Constitution and Rules of Procedure) Regulations 2013, the Judgment of the Tribunal is that:[1]The Respondent has made an unauthorised deduction from the Claimant's wages and is ordered to pay the Claimant the gross sum of £265.88. This sum being £1598.38 claimed in respect of unpaid wages (£168.25 hours x £9.50 per hour) less payments acknowledged by the Claimant as having been made by the Respondent totaling £1332.50[2]The Respondent has failed to pay the Claimant’s mileage expenses in breach of contract and is ordered to pay the gross sum of £319.59 in respect of that breach (710.2 miles x 45p per mile).[3]The sums payable above are the gross amounts to be paid and the claimant is responsible for any income tax and National Insurance contributions thereon.
