[1]The Claimant was unfairly dismissed.[2]The Respondent is ordered to pay to the Claimant a compensatory award of £5702.75 calculated as follows:- Loss of earnings to date 26/9/18 to 30/1/19 18 wks @ £346.22= £6231.96 Less earnings to date £1442.71 £4789.25 Future loss of earnings 26wks @ £346.22 less £110.98= £235.2 £6116.24 Loss of statutory rights £ 500.00 Subtotal £11405.49 Less 50% Polkey Reduction Total £5702.75[3]The Respondent having paid an additional £762.00 to the Claimant today for a further week and a half’s redundancy pay the basic award is extinguished.[4]The recoupment regulations do not apply.
