JUDGMENT
[1]The date of payment of wages from which the claimed deduction was made was before the period of 2 years ending with the date of presentation of the complaint. The claim of an unlawful deduction from wages is therefore out of time under Section 23(4A) of the Employment Rights Act 1996. The Tribunal has no jurisdiction to consider it and it is dismissed.[2]In the alternative and in any event the claim of an unlawful deduction from wages is out of time. It was reasonably practicable for the claim to be presented in time. Accordingly, the Tribunal has no jurisdiction to hear the claim, and it is dismissed. Case No:1304384.20
