JUDGMENT

Upon the parties indicating that terms of agreement have been reached and are awaiting the formal COT3 documentation to conclude the agreement, this PH will be adjourned pending confirmation that the Claims can be dismissed upon withdrawal. Case Number 1304255/2017 1300012/2018

REASONS

This matter was listed today for a Closed Telephone Preliminary Hearing in order to determine the issues and to thereafter timetable the matter for final hearing. The Claimant has brought claims of race discrimination, disability discrimination and victimisation in a Claim Form received on 13 December 2017 against the parties named above. At the outset of the call I was informed by the parties that terms had been agreed between them to resolve matters and a COT3 was in the process of being drawn up and concluded. In those circumstances I advised that I would adjourn this Preliminary Hearing and await final confirmation from the parties that matters had been compromised whereupon the matter would be dismissed upon withdrawal. The parties are requested to confirm settlement as soon as possible but in the event that a binding agreement is not reached then the parties should seek a further listing for this Preliminary Hearing.
