[1]By a letter dated 10/11/2023 the Tribunal gave the claimant and the respondent an opportunity to make representations or to request a hearing, as to why the claim and/or the response should not be struck out because:• Neither had complied with the Order of the Tribunal dated 12/06/2023, in that both parties failed to attend final hearing on 10/10/2023, without explanation, despite joining instructions being sent to both parties on two separate occasions by email.• the claimant had not complied with the Order of the Tribunal dated 2/10/2023 to provide details of the losses claimed in the claim (otherwise referred to as a schedule of loss).• Neither party has complied with the Tribunal's further order sent by email 2/10/2023 to work together to prepare a bundle of the relevant documents for the hearing and submit this to the Tribunal by 6/10/2023 or inform the Tribunal by this same date that they were ready for the hearing.• it has not been actively pursued.[2]The claimant and/or the respondent has failed to make representations in writing as to why this should not be done or to request a hearing.
