JUDGMENT
[1]The Age discrimination claim is dismissed upon withdrawal.[2]Upon no Response being entered and the Tribunal considering that there will be no material prejudice to either party, the Tribunal orders that the Preliminary Hearing listed for today shall be treated as a final hearing pursuant to Rule 48 of the Employment Tribunal (Constitution and Rules of Procedure Regulations) 2013.[3]The Claim for unfair dismissal is well founded. The Claimant is awarded £11,333.52 in respect thereof comprising of a Basic Award of £1,020 and a Compensatory Award of £10,313.52.[4]The Claimant was not provided with a statement of his employment particulars and, pursuant to section 38 of the Employment Act 2002, is awarded £1,163.44.[5]For the avoidance of doubt the total sum payable to the Claimant by the Respondent on account of this Judgment is £12,496.96.
