JUDGMENT
[1]The claimant has proven his claim for accrued unpaid holiday pay during the leave year beginning 1 November 2017, prior to the termination of his employment on 9 April 2018.[2]The claimant has not proven a claim for holiday pay prior to 1 November 2017 and that part of his claim is dismissed.[3]I also dismiss as unproven his claim under s.38 Employment Act 2002 of a failure by the respondent to give a statement of employment particulars.[4]I order the respondent to pay the claimant a gross sum of £881.80, subject to the deduction of normal statutory deductions, which deductions shall be particularised in an itemised pay statement duly issued to the claimant at the time of payment of the net amount due.
