JUDGMENT

[1]Under section 163 Employment Rights Act 1996 it is determined that the claimant is entitled to a statutory redundancy payment of £7,957.88.[2]The complaint of breach of contract in relation to notice pay is wellfounded. The respondent shall pay the claimant the sum of £869.28 as damages for breach of contract in respect of the failure to provide her with statutory notice from 9 January 2024 to 2 February 2024 (3 weeks 3 days based on a weekly wage of £568.42 = £1949.68 less £1080.40 the claimant received from the Insolvency Service). This figure has been calculated using gross pay to reflect the likelihood that the claimant will have to pay tax on it as Post Employment Notice Pay.
