JUDGMENT

Employment Tribunals Rules of Procedure 2013 – Rule 21[1]The claim was issued in the Midlands (West) Employment Tribunals on 10 September 2021 and was sent to the respondent, to its registered office address, on 17 September 2021. The respondent has failed to present a valid response on time. The Employment Judge has decided that a determination can properly be made of the claim in accordance with rule 21 of the Rules of Procedure.[2]The respondent has been in Administration since 31 January 2022. The Administrators have confirmed they have no objections to the claim continuing.[3]The respondent made unauthorised deductions from the claimant’s wages and must pay him the amount of those deductions: £1,876.00[4]It is noted that the claimant has claimed an additional sum of £1200, said to be for “savings withdrawn”. The basis upon which he is claiming this is unclear. He is entitled to compensation for underpaid wages. If he were to be awarded the £1200 on top of the amount of the underpaid wages, this would be double recovery.
