[1]The Claim was listed for Final Hearing by CVP on 16 and 17 August 2023 as set out in the Notice of Hearing dated 16 May 2023. Details of how to join the hearing were sent by the Tribunal to the parties on 8 August 2023.[2]The Respondent made an application for strike out of the Claimant’s claim on 11 August 2023 on the basis that the case was not ready for hearing because of the Claimant’s non-compliance with the Tribunal’s case management orders. The Claimant did not respond to the application.[3]The Claimant did not attend the Final Hearing by CVP on 16 August 2023. He did not contact the Tribunal or the Respondent. The Tribunal contacted the Claimant by email and telephone. He did not respond.[4]The Claimant did not complete disclosure or exchange witness statements with the Respondent prior to the Final Hearing.[5]The Claimant’s claim was therefore struck out on the following grounds:• Non-compliance with the Tribunal’s Orders dated 16 May 2023• Non-attendance at the Final Hearing on 16 and 17 August 2023• It has not been actively pursued 6.2 Strike out Judgment – claim - rule 37 Case No:1303979/2023[6]The hearing fixed for 16 and 17 August 2023 will not take place.
