Mr K Drinkwater v Secretary of State for BEIS: 1303733/2018

EMPLOYMENT TRIBUNALS
Case No 1303733/2018
Mr K DrinkwaterClaimantSecretary of State for BEISRespondent
Employment Judge BroughtonDate 1 November 2019

JUDGMENT

The original first respondent is now dissolved and there has been no application to restore them to the register. In the absence of the parties I have considered the submissions and evidence provided. The claimant, understandably in the circumstances, appears to not be pursuing his claims for unfair dismissal and notice pay and so those claims are dismissed. In the absence of direct evidence the claims for holiday pay are unsubstantiated and are dismissed. There was, however, evidence (payslips) of the claimant being paid less than his contractual entitlement from August 2017 to March 2018. There was also evidence that he had outstanding pay due on termination of his employment. He said that this was his entire salary for March 2018 and that appears to be correct. He is, therefore, awarded (gross and subject to the BEIS limits, rules and deductions in relation to entitlements) For unpaid wages (monthly underpayments) £ 593.09 For March 2018 £ 1145.63 Less monies owed by claimant £ (90.00) Total £1648.72 Case Number: 1303733/2018 In the absence of the claimant any and all other claims are dismissed.
