JUDGMENT
[1]The claimant was dismissed by reason of redundancy and is entitled to a redundancy payment.[2]The respondent breached the claimant’s contract of employment by failing to give her notice of termination of her employment.[3]The claimant did not pursue a declaration that she was unfairly dismissed; that claim is therefore dismissed.[4]The respondent is ordered to pay the claimant £1,985.90 which comprises:4.1 A redundancy payment of £853.864.2 £1,132.04 in respect of its failure to give notice of termination of employment consisting of4.2.1 £1,082.68 damages for loss of earnings4.2.2 £49.36 damages for loss of pension benefits.[5]The Recoupment Regulations do not apply.
