JUDGMENT

The complaint that the claimant was unfairly dismissed is struck out.

REASONS

[1]The claimant complains of unfair dismissal.[2]Her effective date of termination was 05 March 2018. Limitation for the purposes of the termination of her employment would ordinarily expire on 04 June 2018. For the purposes of early conciliation, date A – the date of referral to ACAS – was 8 June 2018 and Day B – the date when early conciliation ended – was 17 June 2018. The limitation date was not extended by Early Conciliation The claim for unfair dismissal was presented on 19 June 2018 and was therefore lodged out of time.[3]Therefore the claimant is not entitled to bring such a complaint.[4]The claimant has failed to give an acceptable reason, despite being given the opportunity to do so, why the complaint should not be struck out.[5]Accordingly, the complaint of unfair dismissal is struck out. The claimant’s other complaints are not affected by this judgment.
