JUDGMENT

The claimant’s allegations at 3.5, 3.6, 3.7, 3.8, 3.9, 3.13. 3.15 and 5.2.5 set out in the list of issues in EJ Wedderspoon’s case management order of 13 February 2023 are struck out.

REASONS

[1]The claimant was ordered to pay a deposit of £300 per allegation (a total of £2400) following a preliminary hearing held on 27 September 2023. The order was sent to the claimant on 4 October 2023. The claimant has failed to pay this deposit. The relevant allegations are therefore struck out under rule 39(4) of the Employment Tribunals Rules of Procedure 2013.[2]The hearings remain listed as per my case management order and any variation to the listing of the final hearing can be discussed at the preliminary hearing in March .
