JUDGMENT
[1]The Claimant’s complaint of breach of contract (failure to pay notice pay) was presented outside the statutory time limit.[2]It was reasonably practicable for the Claimant to have presented this complaint within the statutory time limit. The Tribunal has no jurisdiction to hear this claim and it is therefore dismissed.[3]The Claimant’s complaint of unlawful deduction from wages was brought within the statutory time limit and the Tribunal has jurisdiction to hear this claim.[4]The Respondent has made unlawful deductions from the Claimant’s wages and is ordered to pay to the Claimant the sum of £1126.67 x 4 = £4,506.68 (being gross pay due to her for the months of October, November and December 2020 and January 2021) in respect of the unlawful deduction from wages.[5]The Respondent is entitled to make appropriate deductions which are due for tax and national insurance contributions on the above payment before it is paid to the Claimant.
