JUDGMENT

Upon the Respondent failing to attend, and the clerk attempting to make contact by telephone but being unable to do so, and the Tribunal delaying the start of the hearing to give the Respondent time to arrive, the Tribunal went ahead in the Respondents absence and gave the following Judgment.[1]The complaint of unlawful deductions from wages is well founded and the Respondent is ordered to pay the Claimant £2105.[2]The complaint of failure to pay accrued but untaken holiday pay is well founded and the Respondent is ordered to pay the Claimant £1537.71.[3]The awards are uplifted by £1656 (4 weeks’ pay) under S38 Employment Act 2002 on account of the Respondent failing to issue the Claimant with any statement of particulars of employment.
