Mr J Hnatyszyn v United Parcel Service Ltd: 1302271/2020
JUDGMENT
The claim is struck out.REASONS
[1]By a letter dated 17th May 2021 the Tribunal gave the claimant an opportunity to make representations or to request a hearing, as to why the claim should not be struck out because• the claimant had not complied with the Order of the Tribunal dated 27 July 2020, in particular paragraph 4.1 of that Order.• it has not been actively pursued. In particular you have failed to engage with the respondent in cases preparation and failed to comply with case management orders as set out in the respondent’s correspondence dated 8 April, 21 October and 17 September. You have also failed to respond to the respondent’s applications made within that correspondence.[2]The claimant has failed to make representations in writing, or has failed to make any sufficient representations, why this should not be done or to request a hearing. The claim is therefore struck out.[3]The hearing fixed for Tuesday 1st June, Wednesday 2nd June, Thursday 3rd June and Friday 4th June 2021 will not take place.
