Mr D Weaver v Wilmott Dixon Holdings Ltd and Fortem Ltd: 1302210/2025
JUDGMENT
The claimant’s claims are dismissed.REASONS
[1]The Claimant failed to attend today and was unable to be contacted by telephone. He remains employed by the second Respondent.[2]He had previously indicated that he wished to withdraw due to the unavailability of free legal advice or representation. He had requested a postponement of the previous preliminary hearing on similar grounds.[3]The Claimant had failed to respond to previous directions regarding the provision of information regarding the nature of his claims, the correct Respondent and specific details and evidence of his various alleged disabilities.[4]There had been no communication from the Claimant since 20 November 2025.[5]Accordingly, there were, potentially, grounds for strike out for failing to comply with Tribunal orders and / or for failing to actively pursue the claims.[6]The Respondent had live applications for strike out and for costs. Case Number: 1302210/2025[7]In all those circumstances, it was in the interests of justice to dismiss the claims for non-attendance today under rule 47 Employment Tribunal Rules of Procedure 2024.
