JUDGMENT

Employment Tribunals Rules of Procedure 2013 – Rule 21[1]The claim was issued in the Midlands West Employment Tribunals on 6 May 2022. The respondent has failed to present a valid response on time. The Employment Judge has decided that a determination can properly be made of the claim, or part of it, in accordance with rule 21 of the Rules of Procedure.[2]The claimant was dismissed in breach of contract in respect of notice and the respondent must pay damages to the claimant of £4212.54 net (9 weeks’ notice).[3]The claimant was dismissed by reason of redundancy and is entitled to a redundancy payment of £5168.[4]The respondent has failed to pay the claimant’s holiday entitlement of 3 days and must pay the claimant £346.14 gross.[5]Therefore, the respondent must pay the claimant £346.14 in total gross, net compensation of £4212.54 and a redundancy payment of £5168.[6]The sums payable under paragraph 4 above are to be paid to the claimant gross and the claimant is to be responsible for any income tax and employee national insurance contributions thereon.[7]The hearing listed on 23 November 2022 is cancelled.
