JUDGMENT
[1]The claimant’s claim of breach of contract (notice pay) is well founded and succeeds. The claimant is awarded the sum of £442.30.[2]The respondent has made an unauthorised deduction from the claimant's wages and is ordered to pay the claimant the sum of £2388. This is made up of the sum of £1548 (net of income tax and National Insurance Contributions) in respect of unpaid wages and £840 gross unpaid commission (which commission would be subject to the payment of any income tax and National Insurance Contributions thereon)[3]The claimant’s claim for accrued holiday pay is also well-founded and succeeds. The respondent is ordered to pay to the claimant the sum of £796.15 (subject to the payment of any income tax and National Insurance Contributions thereon).
