JUDGMENT

[1]It is not disputed that the Respondents failed to comply with the requirements of Section 188 Trade Union & Labour Relations (Consolidation) Act 1992 and therefore the Tribunal makes a declaration that there was a breach of the provisions of that section.[2]The Tribunal accordingly makes a protective award in respect of all Drivers or Shunters of Almtone Limited (or its subsidiaries Canute Logistics Ltd, Canute Engineering Ltd and Canute Medical Ltd) based at the Coventry, Retford (Gamston), Lancaster or Newport establishments, dismissed between 21 December 2018 and 31 January 2019.[3]The protected period is a period of 90 days commencing 21 December 2018.
