JUDGMENT
[1]It is declared that the claimant was unfairly dismissed and is entitled to a basic award of £7,837 and a compensatory award of £9,135, comprising £7,710 for loss of earnings, £470 for loss of statutory rights and £950 pursuant to section 38 of the Employment Act 2002.[2]The claimant is entitled to the sum of £370 by way of notice pay.[3]The claim for arrears of pay is dismissed.[4]The claim for outstanding holiday pay is dismissed upon withdrawal by the claimant.[5]The respondent is to pay the claimant the sum of £1,200 in respect of tribunal fees incurred in bringing these proceedings.[6]The recoupment provisions applicable to this judgment are set out in the attached Recoupment Notice.
