JUDGMENT

[1]The claimant’s claim for a redundancy payment is dismissed on withdrawal by the claimant.[2]The respondent is ordered to pay the claimant unpaid wages in the sum of £978.21 gross (140.75 hours @ £6.95 per hour).[3]The respondent is ordered to pay the claimant unpaid notice pay in the sum of £992.28. (1 months hours: 140.75 x £7.05(increase to NMW on 1/4/17)).[4]The claimant has paid fees in connection with this claim. In R (on the application of UNISON) v Lord Chancellor [2017] UKSC 51 the Supreme Court decided that it was unlawful for Her Majesty's Courts and Tribunals Service (HMCTS) to charge fees of this nature. HMCTS has undertaken to repay such fees. In these circumstances I shall draw to the attention of HMCTS that this is a Note: written reasons will not be provided unless requested at the Hearing itself or in writing within 14 days of the sending of the written record of the decision, Rule 62(3). Case Number: 1301629.17 case in which fees have been paid and are therefore to be refunded to the claimant. The details of the repayment scheme are a matter for HMCTS.
