Ms L Clougher v Lidl Great Britain: 1301328/2022
JUDGMENT
At the start of the Open Preliminary Hearing on 18 April 2023 it was ORDERED Pursuant to Rules 50(1) and (3)(a) of the Employment Tribunals Rules of Procedure 2013, it being in the interests of justice to do so, that the Open Preliminary Hearing would be converted to a Closed Preliminary Hearing and would continue being heard in private. Following that preliminary hearing the judgment of the Tribunal is that:[1]The Claimant’s application to amend her claim to include a claim of constructive unfair dismissal (as detailed at para 15.4 of the Case Management Orders from the Preliminary Hearing on 11 October 2022) is allowed;[2]The Claimant’s application to amend her claim to include a claim of sex discrimination (as detailed at para 15.2 of the Case Management Orders from the Preliminary Hearing on 11 October 2022) is refused;[3]The Claimant’s claims are out of time for the reasons given in the hearing. The Tribunal therefore has no jurisdiction to consider the Claimant’s claims and they are dismissed in their entirety. Appeal Number:
