Employment Tribunals Rules of Procedure 2013 – Rule 21[1]The claim of unauthorised deduction from wages succeeds as the respondent has failed to pay the claimant wages due for the period 22 November to 17 December 2021. I order the Respondent to pay to the claimant the sum of 2346.95 (gross) which is calculated as wages owed for 74.5 hours at El 3.50 per hour less wages paid of 2658.80;[2]The respondent has failed to pay holiday pay in accordance with the Working Time Regulations 1998 and I order the Respondent to pay the sum of E 411.75 (gross) to the claimant;[3]The claimant was dismissed in breach of contract and is entitled to one week's pay in lieu of notice and the respondent is ordered to pay the sum of E540.OO (gross);[4]I make no award for emotional and financial hardship claimed as the claimant has not provided any evidence of financial loss caused by the failure to pay[5]The hearing listed on 6 July 2022 is cancelled.
