JUDGMENT
[1]The name of the respondent is amended to DA Civils Ltd.[2]The respondent failed to attend or be represented at the Hearing. The tribunal considered the information in its possession and decided to proceed in its absence.[3]The claimant’s claim for damages for breach of contract of employment (notice pay) succeeds. The respondent is ordered to pay the claimant the net sum of £1200 (2 weeks at £600 net a week).[4]The claimant’s claim for holiday pay is withdrawn by the claimant and is dismissed.[5]The respondent has made an unauthorised deduction from the claimant’s wages. The respondent is ordered to pay the claimant £220 (£160 and £60).[6]The claimant was unfairly dismissed. The respondent is ordered to pay the claimant compensation for unfair dismissal of £15204 (see the Schedule attached). The Recoupment Regulations do not apply.
