JUDGMENT
The claimant is not a person with a disability within the meaning of section 6 of the Equality Act 2010.REASONS
[1]On 12th October 2018, following an in person Preliminary Hearing, this matter was listed for a preliminary hearing to be heard on 17th December 2018 to deal with the question as to whether the claimant was a disabled person within the meaning of s.6 Equality Act 2010 by reason of “workplace contact dermatitis”. Case number 1301132/18[2]Neither party attended the preliminary hearing before me today. I waited until 10.15am and then asked the clerk to make contact with the parties. This proved to unsuccessful.[3]As such I put the case back in case the parties attended the Tribunal late and dealt with another case in the interim. At 2.30pm I checked with the clerk and there had still been no contact from either party nor had anyone attended the Tribunal.[4]In the absence of any evidence on file in support of the claimant’s disability I determine that the claimant is not a person with a disability pursuant to section 6 of the Equality Act.
