Mr R SmithClaimantSkillwise and Beacon Primary SchoolRespondent
Employment Judge GaskellIn person for claimantDate 21 June 2017

JUDGMENT

Upon the claimant conceding that, at no time material to this claim, was he employed by the second respondent. The judgment of the tribunal is that:[1]The employment tribunal has no jurisdiction to consider a breach of contract claim against the second respondent who was not the claimant’s employer.[2]The claimant’s claim against the first respondent was presented out of time and it was reasonably practicable for the claim to have been presented within time.[3]Accordingly, the claimant’s claims against both respondents are dismissed for want of jurisdiction.
