JUDGMENT

[1]There shall be judgment (by consent) for the claimant in respect of unpaid notice pay, holiday pay and unpaid wages in the sum of £1,044.47 (net).[2]The claim for unpaid mileage is dismissed.[3]The respondent’s counter-claim for the recoupment of commission paid shall be offset against and limited to any award for unpaid commission. The claimant’s claim for unpaid commission at its highest being less than the total amount of claimed by the respondent through the counter-claim, the claimant’s claim for unpaid commission is determined as being in the sum of £0.00.[4]The tribunal having determined that the counter-claim for recoupment of commission paid shall be limited pursuant to the terms of the contract of employment to being recouped against any payments for commission only, the respondent’s counter-claim is determined as being in the sum of £0.00.
