[1]It is declared that the Respondent was in breach of Regulation 5 of the Agency Worker Regulations 2010 and shall pay to the Claimant the sum of £2,388.57 gross less appropriate tax and national insurance deductions in respect thereof.[2]The Claim for unpaid holiday pay is well founded and the Respondent shall pay £216.44 less appropriate tax and national insurance deductions in respect thereof.[3]It is declared that there was an unlawful deduction from wages and the Respondent shall pay £802.90 less appropriate tax and national insurance deductions in respect thereof.[4]For the avoidance of doubt the Respondent shall pay to the Claimant the total gross sum of £3,407.91 90 less appropriate tax and national insurance deductions in settlement of this Claim.
