Ms R Kotecha v Boots UK Ltd and others: 1300485/2016

EMPLOYMENT TRIBUNALS
Case No 1300485/2016
Ms R KotechaClaimantBoots UK Ltd and othersRespondent
Employment Judge DimbylowDate 16 March 2017

JUDGMENT

Upon the claimant’s application for reconsideration received in 2 parts on 16 February 2017 (by emails timed at 15:58 and 16:08) in relation to a judgment made by the tribunal on 20 January 2017, which was sent to the parties with reasons on 2 February 2017: the application is refused.

REASONS

The application is refused because I conclude that there are no reasonable prospects of the original decision being varied or revoked. The grounds and facts advanced by the claimant do not reveal any procedural mishap, shortcoming or occurrence. The claimant does refer to a potential mishap in the fact that I do not mention in my reasons her further submissions lodged at the tribunal on 18 January 2017. They were received by email timed at 16:26. I had them before me when I made my decision and took them into account. I made notes on a working copy on the file. I should have mentioned them at the end of paragraph 11 of my reasons. I do refer to the 3 cases which came with those submissions in paragraph 29 of my reasons. I find that the claimant wishes to reopen the discussion about the facts, which were considered on 20 January, and for me to come to a different conclusion upon them. Therefore, it is just, fair and proportionate to refuse the application.
