The claim is dismissed.REASONS
This is a claim for 70 hours holiday pay. I have dismissed it because: the claimant did not attend (without warning or explanation) or send in any written / documentary evidence; although the respondent’s defence is rather vague, on the face of the claim and response forms – which are all I have to go on – things are not so clear cut that I feel able to award the claimant anything without any evidence from her at all; the burden of proof is on the claimant and she has failed to prove her case.
