[1]Save for the issue at (4) below the claimant’s application for strike out and/or a deposit were confirmed as pursued solely on the basis of timing matters.[2]The claimant’s complaints that were pursued on the basis of(i) race and/or(ii) religion were presented in time.[3]The claimant’s wages complaints were not presented in time, it was reasonably practicable for them to be presented in time and the tribunal does not have jurisdiction to hear those complaints.[4]The respondent’s application to withdraw its application for strike out pursuant to r. 37(1)(e) is granted on the basis it could be re-made if prejudice became apparent as a result of disclosure. A separate case management order follows.
