Employment Tribunals Rules of Procedure 2013 – Rule 22[1]The claimant was dismissed in breach of contract in respect of notice and the respondent is ordered to pay damages to the claimant in the sum of £68.64 (one week’s pay; gross figure but not subject to deductions for tax/NI).[2]The respondent has failed to pay the claimant’s holiday entitlement and is ordered to pay the claimant the sum of £215.18 (gross figure but not subject to deductions for tax/NI). Holiday pay calculated as follows; claimant worked 1 day a week, 6 hour shift. 5.6 weeks x 6 hours = 33.6 hours total annual leave entitlement for a year. 0.56 of the leave year had expired when claimant left her employment. 33.6 hours x 0.56 = 18.81 hours.[3]The claim of unfair dismissal contrary to Regulation 5 of the Part Time Worker (Prevention of Less Favourable Treatment) Regulations 2000 is dismissed on withdrawal by the claimant.
