JUDGMENT
[1]By consent the respondent is ordered to pay to the claimant the sum of £1,880.35 in respect of outstanding holiday pay pursuant to the Working Time Regulations 1998.REASONS
[1]This matter was listed before me this morning as a contested application by the claimant for unpaid holiday pay. In the Response the respondents disputed that the claimant was a worker within the meaning of the Working Time Regulations 1998.[2]At the outset of the Hearing the parties’ attention was drawn to regulation 36 of the Regulations. Having considered these matters the respondents, wisely, in my view accepted that the claimant was a worker.[3]Having so accepted it was then a matter of working through the figures which the parties did collaboratively, with my involvement, in order to see if we could reach an agreed figure as to the amount of outstanding holiday pay. Having done that exercise we were agreed between ourselves that the net figure due to the claimant is £1,880.35 which figure the parties agreed should form the basis of a consent judgment.
