JUDGMENT

The claim is struck out under rule 37 of the Rules contained in Schedule 1 of the Employment Tribunals (Constitution and Rules of Procedure) Regulations 2013 on the grounds that the claim has not been actively pursued in terms of rule 37(1)(d)

REASONS

[1]On 7 March 2017 the Tribunal wrote to the claimant advising that her claim may be struck out under Rule 37 (1)(d) of the Employment Tribunal rule.[2]The Tribunal was contacted by the Claimants Husband, who advised she has passed away; he indicated that he does not wish to have any further contact from the Employment Tribunal.[3]The Tribunal therefore strikes out the claim, under Rule 37(1)(d) of the Rules.
