JUDGMENT

The claim is struck out under rule 37 of the Rules contained in Schedule 1 of the Employment Tribunals (Constitution and Rules of Procedure) Regulations 2013 on the grounds that the claim has not been actively pursued in terms of rule 37(1)(d).

REASONS

[1]On 12 March 2019 the Tribunal wrote to the Claimant enquiring if he still wished to pursue his equal pay claim[2]The letter has been returned (RTS gone away). As it is not possible to contact the Claimant the Tribunal therefore strikes out the claim.[3]If circumstances later come to light which means that the Claimant had been unaware of the circumstances or it was otherwise in the interest of justice to do so, the Claimant could apply to the Tribunal for a reconsideration of the strike out decision and for his claim to be reinstated.
