JUDGMENT
The Judgment of the Employment Tribunal is that, on reconsideration, the respondent shall pay to the claimant additional interest in the sum of £232 (being interest at the rate of 8% on the sum of £1,440.37 from the original midpoint to 19 May 2023). E.T. Z4 (WR)REASONS
[1]The claimant claimed a breach of the sex equality clause in her contract of employment with the respondent. The parties agreed a sum to be awarded for arrears of pay of £13,419. The respondent was obliged to make statutory deductions from the above sum before paying the claimant. In accordance with guidance from HMRC the deductions were understood to total £3,233.[2]Interest was claimed on the award for arrears of pay. The rate of interest is 8%. Interest began to accrue from the midpoint between 21 June 2001 to 13 May 2021 (the date of the original judgment). It was agreed that the number of days since the midpoint was 3,633.[3]Interest was awarded on the sum of £10,186 (£13,419 – £3,233) on the basis that this was the amount that the claimant was not paid by the respondent because of their breach of the sex equality clause. Interest was therefore awarded in the sum of £8,111 being 8% on the sum of £10,186 from the midpoint between 21 June 2001 to 13 May 2021 (3,633 days). It was agreed that if the sum paid to the claimant after statutory deductions was more than £10,186 it was open to the claimant to seek a reconsideration of the judgment in relation to the sum awarded for interest.[4]It is agreed that the sum outstanding to the claimant after statutory deductions is £1,440.37. The claimant has sought reconsideration of the judgment in relation to the sum awarded for interest to take account of the above outstanding sum.[5]On reconsideration of the judgment dated 14 May 2021, the additional interest due to the claimant has been awarded of £232. This sum has been calculated by including interest at the rate of 8% for the 735 days since the original judgment was issued.
