JUDGMENT

The claim is struck out under rule 37 of the Rules contained in Schedule 1 of the Employment Tribunals (Constitution and Rules of Procedure) Regulations 2013 on the grounds that the claim has not been actively pursued in terms of rule 37(1)(d).

REASONS

[1]On 23 January 2017 the Tribunal gave the claimant an opportunity to indicate how she wished to proceed with the claim by the 6 February 2017.[2]The Tribunal was contacted by the Claimant’s son-in-law on 6 March and 16 March 2017, who advised that the claimant had passed away. He indicated that the claimant’s husband had directed him to inform us that the case should be closed.[3]The Tribunal therefore strikes out the claim, under Rule 37(1)(d) of the Rules.
