JUDGMENT
The claims are struck out under rule 37 of the Rules contained in Schedule 1 of the Employment Tribunals (Constitution and Rules of Procedure) Regulations 2013 on the grounds that the claims have not been actively pursued in terms of rule 37(1)(d)REASONS
[1]On 3 November 2023 the Tribunal gave the claimant an opportunity to confirm by 17 November 2023 why her claims should not be struck out on the grounds that they had not been actively pursued. The claimant responded to confirm that she wished to proceed with her claims. The respondent informed the Tribunal that the claims were settled in December 2016. The Tribunal wrote to the claimant on 5 February 2024 requesting that she confirm whether this was the case and if so, whether the claims were to be withdrawn. There has been no response from the claimant.[2]In all of the circumstances, the claims have been struck out on the grounds that they have not been actively pursued.
