Mrs J Gillies v Highland Council: 101756/2008 and 112594/2008
JUDGMENT
The claims are struck out under rule 37 of the Rules contained in Schedule 1 of the Employment Tribunals (Constitution and Rules of Procedure) Regulations 2013 on the grounds that the claims have not been actively pursued in terms of rule 37(1)(d).REASONS
[1]On 19 February 2019 the Tribunal wrote to the Claimant enquiring if she still wished to pursue her equal pay claims.[2]The letter has been returned (RTS gone away). As it is not possible to contact the Claimant the Tribunal therefore strikes out the claims.[3]If circumstances later come to light which means that the Claimant had been unaware of the circumstances or it was otherwise in the interest of justice to do so, the Claimant could apply to the Tribunal for a reconsideration of the strike out decision and for her claims to be reinstated.
